Introduction

Rafael Alcácer Guirao holds a PhD in Law from the Complutense University and is Professor of Criminal Law at King Juan Carlos University in Madrid, through whose Innovation and Transfer Unit (CINTTEC) he provides services for the firm Oliva-Ayala Abogados SLP.

Mr Alcácer Guirao is an expert in the theory of crime and guarantees of criminal procedure, subjects on which he has published numerous monographs and given courses and conferences in Spain, Germany, Portugal, Chile, the Dominican Republic, Peru and Argentina. He has been a contracted researcher in the framework of the Ramón y Cajal programme, having carried out research stays at the Universities of Mannheim and Munich. He has been director of the Master’s Degree in Economic Criminal Law at King Juan Carlos University, where he also teaches. He also teaches regularly in various forums, including the course on access to the constitutional legal aid office and the course on access to the legal profession, both at the Madrid Bar Association, and the course on High Specialisation in Criminal Law at the School of Legal Practice of Complutense University.

In addition to his teaching and research work, he has worked for several years as judge pro-tem at the Provincial Court of Appeals of Madrid and, before joining Oliva-Ayala through King Juan Carlos University, he was a lawyer at the Constitutional Court for eight years.
His practice focuses on preventive advice and criminal risk management for Spanish and foreign companies, and on procedural defence for individuals and companies in complex matters of tax crime, corporate and property crime, market and consumer crime, public and private corruption and money laundering cases, among others.
He is also actively involved in representing clients in extradition proceedings, and is a specialist in defence of fundamental rights, bringing cases before the Constitutional Court and the European Court of Human Rights.

His extensive theoretical and practical experience in criminal procedure and the theory of crime allows him to offer comprehensive legal advice, placing him in an excellent position to successfully deal with the matters of the clients who come to Oliva-Ayala Abogados.

EDUCATION

  • Doctor in Jurisprudence from the Complutense University of Madrid with a doctoral thesis on the theory of crime, which was awarded the highest mark.
  • During his time as a researcher contracted under the Ramón y Cajal programme, he carried out several research stays at the universities of Mannheim and Munich.
